These Terms of Service ("Terms") govern your use of this website and your purchase of our digital products. By using the website or placing an order, you agree to these Terms. If you don't agree, please don't use the site. Nothing in these Terms affects the rights you have as a consumer under the laws of your province or territory.

1. Who we are

This store is operated by The Happy Fryer ("we", "us", "our"), a business established in Spain (Plaza de los Fueros 4, 31780 Bera, Navarra, Spain), contactable at support@thehappyfryer.net.

2. Eligibility

You must be at least 18 years old (or the age of majority in your province or territory, if higher) to buy from us. If you are younger, a parent or guardian must place the order.

3. What we sell

We sell digital ebooks: air fryer recipe collections and meal-planning guides, supplied as downloadable PDF files. No physical goods are sold or shipped.

Our products are for general information and personal use. Recipes, nutrition estimates and meal plans are not medical, dietary or nutritional advice, and are not intended to diagnose, treat or prevent any condition. If you have a medical condition or a food allergy, are pregnant, or follow a special diet, speak to your doctor or a registered dietitian before changing how you eat. Always check ingredient labels for allergens.

You are responsible for safe food handling, including cooking food to a safe internal temperature checked with a food thermometer (Health Canada recommends, for example, 74 °C (165 °F) for poultry and leftovers and 71 °C (160 °F) for ground meat), and for using your air fryer according to its manufacturer's instructions. Cooking times and temperatures are guidelines and may need adjusting for your model.

4. Orders and prices

All prices are in Canadian dollars (CAD). There are no shipping charges on digital products. Sales tax (GST/HST, and QST in Quebec) is added only where we are required to collect it, and is shown at checkout before you pay.

Before you pay, you can review your order, correct any errors, and accept or cancel it. Your order is accepted when we make your download links available and send your confirmation email, which serves as your copy of the agreement. We may change prices, run promotions or withdraw products at any time; a change never affects an order you have already completed. If a product is listed at an obviously wrong price because of a technical or human error, we will tell you and, if you don't want to go ahead at the correct price, cancel the order and refund you in full.

5. Payment

Payments are processed securely by Shopify and its payment providers. We never see or store your full card details.

6. Our 30-day money-back guarantee

Every purchase has our voluntary 30-day money-back guarantee, explained in our Refund Policy, which forms part of these Terms and is in addition to your rights under provincial law.

7. Your licence to use our ebooks

When you buy an ebook, we grant you a personal, non-exclusive, non-transferable licence to download, read, print and keep it for your own private, non-commercial use, for life. You may use the recipes to cook for your household, family and friends.

You may not:

  • resell, rent, sublicense, share or otherwise distribute the files;
  • upload them to file-sharing sites, social media, forums, publicly shared cloud folders, or datasets used to train artificial intelligence;
  • share your download links publicly;
  • copy substantial parts of the content for commercial use, or present it as your own.

We (and our licensors) keep all copyright and other intellectual property rights in our products and in this website's content. If you break these licence terms, we may end your licence.

8. Reviews and testimonials

Reviews and testimonials on our site come from real customers and reflect their own experience; individual results vary. Where a review comes from a customer outside Canada or has been translated, we say so and show the customer's country. We do not pay for reviews, write them ourselves or post reviews by people who have not used the product, and we do not hide negative reviews because they are negative. If we ever give a customer something in exchange for a review, we will say so next to the review. If you submit a review, you allow us to display it (with your first name and initial) on our site and in our ads, and you confirm it is honest and based on your own use of the product.

9. Acceptable use

You agree not to use this website unlawfully, to try to gain unauthorized access to it, to interfere with how it works, or to scrape or copy it with automated tools.

10. Availability

We aim to keep the website and your download links available at all times, but we can't guarantee uninterrupted access. If you lose access to a product you bought, contact us and we'll restore it.

11. Our responsibility to you

We supply our digital content with reasonable care and skill, and it will match its description and work as it should. If it doesn't, you have the remedies set out in our Refund Policy and under your provincial law. We do not promise any particular weight-loss, health or cooking result.

To the extent permitted by the law of your province or territory, we are not responsible for losses that were not a foreseeable result of our breaking these Terms, or for business losses, as our products are for personal use only. Nothing in these Terms limits or excludes any warranty, condition, right or remedy that cannot be limited or excluded under the consumer protection law that applies to you, or our liability for death or personal injury caused by our negligence or for fraud. Some provinces (including Quebec) do not allow certain limitations of liability, so some of these limitations may not apply to you.

12. Resolving problems

Most problems can be fixed with one email. If you have a complaint, please contact us first at support@thehappyfryer.net and give us 30 days to try to resolve it informally. If we can't, you may bring a claim in the courts of the province or territory where you live (including small claims court) or in any other court with jurisdiction, and you may contact your provincial consumer protection office. Nothing in these Terms requires you to use arbitration or prevents you from taking part in a class action.

13. Governing law

These Terms are governed by the laws of Spain, where our business is established. If you are a consumer living in Canada, this choice of law does not take away the protection of the mandatory consumer protection and privacy laws of the province or territory where you live, and you may enforce your rights in the courts of that province or territory.

14. Changes to these Terms

We may update these Terms from time to time. The version on this page when you place an order is the version that applies to that order.

15. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a term right away, we can still enforce it later. These Terms, together with our Terms of Sale, Refund Policy, Shipping Policy and Privacy Policy, are the entire agreement between you and us about your purchase.

16. Language / Langue
